Terms of Service

These Terms of Service ("Terms") govern your use of Glug ("the app", "we", "us"), a hydration tracking app distributed through the Apple App Store. By downloading, installing, or using Glug, you agree to these Terms. If you do not agree, do not use the app.

The service

Glug helps you track daily water intake, build a hydration streak, and receive reminders. Features include a personalized daily goal, drink logging, home screen and lock screen widgets, and optional notifications.

Subscriptions and billing

Glug offers an optional auto-renewing subscription, "Glug Pro", with the following plans:

Payment is charged to your Apple ID at confirmation of purchase. The subscription automatically renews at the end of each period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

You can manage your subscription and turn off auto-renewal at any time by going to Settings → [Your Name] → Subscriptions on your iOS device. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

Refunds, where applicable, are handled by Apple in accordance with the Apple Media Services Terms.

Free trial

New subscribers may be eligible for a 7-day free trial of the annual plan. If you do not cancel before the trial ends, your Apple ID will be charged the annual subscription fee. You can cancel any time during the trial via Settings on your device with no charge.

Restoring purchases

If you reinstall the app or sign in to a new device with the same Apple ID, you can restore an active subscription using the "Restore Purchases" button on the paywall screen or in the app's Settings.

Health disclaimer

Glug is a general wellness tool and is not a medical device. The app does not provide medical advice, diagnosis, or treatment. Daily water goals are estimates based on the information you provide and general guidance, and are not a substitute for advice from a qualified healthcare professional.

Do not use Glug to make medical decisions. Consult a doctor before changing your hydration habits if you are pregnant, nursing, have a medical condition (including kidney, heart, or endocrine conditions), are taking medication, or have a history of an eating or drinking disorder. Drinking excessive water in a short period can be dangerous.

Acceptable use

You agree not to (a) reverse engineer, decompile, or attempt to extract the source code of the app; (b) use the app for any unlawful purpose; or (c) interfere with the operation of the app or its servers.

Intellectual property

The app, including all content, design, code, and the "Glob" character, is owned by us and is protected by copyright and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

Disclaimer of warranties

The app is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the app. Our total liability for any claim related to the app is limited to the amount you paid us for the app in the 12 months preceding the claim.

Termination

You may stop using the app at any time by uninstalling it. We may suspend or terminate your access to the app if you violate these Terms. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability) will survive.

Apple's role

You acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the app or its content. Apple is a third-party beneficiary of these Terms and may enforce them against you. The Apple-imposed terms of the Apple Media Services Terms and the standard Apple EULA apply to your use of the app.

Governing law

These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict of laws rules. Any dispute arising out of these Terms will be resolved in the state or federal courts located in Cuyahoga County, Ohio.

Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and noted in App Store release notes. Continued use of the app after changes take effect means you accept the updated Terms.
